[NEW] Missouri Paid Sick Leave Postings

A new workplace compliance requirement is on the way for Missouri businesses. Starting May 1, 2025, employers in the state will be required to provide earned paid sick leave to employees. This new law ensures workers can take time off for health-related reasons without losing pay.

How Sick Leave Accrues

Under the law, sick leave accrual depends on the size of the employer. Businesses with 15 or more employees must provide 1 hour of paid sick leave for every 30 hours worked, up to 56 hours per year. Smaller businesses with fewer than 15 employees must also provide 1 hour of paid sick leave for every 30 hours worked, but only up to 40 hours per year. All employees—full-time, part-time, and temporary workers—are counted when determining employer size. If an employer had 15 or more employees for at least 20 weeks in the past year, they must follow the higher accrual requirement.

Employees will start earning sick leave on May 1, 2025, or their first day of employment, whichever is later. Unlike some policies, Missouri’s new law allows employees to use accrued sick leave as they earn it, without a waiting period. Employers also have the option to front-load sick leave for the year instead of requiring employees to earn it over time.

Other key aspects of the law include:

  • Unused sick leave rolls over to the next year, but employers don’t have to let employees use more than the yearly limit.

  • If an employee leaves and returns within 9 months, their previously earned sick leave must be reinstated.

  • If a company changes ownership, employees retain their accrued sick leave.

  • Employers can use a general PTO policy instead of separate sick leave, as long as it meets the law’s requirements.

  • Unused sick leave does not have to be paid out when an employee leaves the company.

Has the Official Poster Been Released?

The Missouri Department of Labor is expected to release an official Paid Sick Leave Poster detailing employee rights and employer responsibilities under this new law. Once available, employers will be required to display it in the workplace to stay compliant.
