2025 Massachusetts Paid Sick Leave [New Download]
Massachusetts' Paid Sick Leave Poster has been updated for 2025, reflecting changes in accrual rates and employer responsibilities. Employers in the state are still required to provide earned paid sick leave to employees, but the updated poster ensures that businesses remain compliant with the latest requirements.
How Sick Leave Accrues
Under the law, sick leave accrual depends on the size of the employer. Businesses with 11 or more employees must provide 1 hour of paid sick leave for every 30 hours worked, up to 40 hours per year. Smaller businesses with fewer than 11 employees must provide 1 hour of sick leave for every 30 hours worked, but it may be unpaid. All employees—full-time, part-time, and temporary workers—are counted when determining employer size. If an employer had 11 or more employees for at least 20 weeks in the past year, they must follow the higher accrual requirement.
Employees begin earning sick leave on their first day of employment. Unlike some policies, Massachusetts’ law allows employees to use accrued sick leave as they earn it, without a waiting period. Employers also have the option to front-load sick leave for the year instead of requiring employees to earn it over time.
Other key aspects of the law include:
Unused sick leave rolls over to the next year, but employers don’t have to let employees use more than the yearly limit.
If an employee leaves and returns within 9 months, their previously earned sick leave must be reinstated by the employer.
If a company changes ownership, employees retain their accrued sick leave.
Employers can use a general PTO policy instead of separate sick leave, as long as it meets the law’s requirements.
Unused sick leave does not have to be paid out when an employee leaves the company.
